Title: My smoking has been shut down by the complex

Letter as follows with complex name removed:

"We have received complaints regarding your grilling on the balcony. We would like to advise you that grilling on anything other than a gas grill is prohibited by Radnor Township and your lease with _____

Therefore, please make sure that any grilling is done on a gas grill only..

Thank you for your cooperation in this matter."



I guess I will be grilling some bradley pucks on the gasser for the foreseeable future and smoking some of the craziest smoke producing cigars.

Then again grudge smoking might not be the answer, I'm still just riled up

The USA is become the "lets listen to the winers" and give them what they want Country. I feel for yah mister. If its not in your contract their aint sheet thay can do until your contract is up ;)

I deal with a lot of stratas if its not in the overview of the building they cant do 0 !!! Mine tried that and just listed the strata rules ..they only way they can get a new rule is via a vote and meeting ( its a pain in the arse for them ) u need anymore advice shoot me a PM happy to help !

Well said, however, while there is nothing in the contract about "anything other than gas grills," there are multiple clauses about "tenant will do nothing...that will disturb other tenants."

I am afraid they will come after my cigars next. Time to simply bite the bullet and buy a house. I haven't as of yet because of how often my work moves me from place to place. Buying a house (and especially having to sell it in this market) is just impractical)

The only clause concerning grills:
"the use of outdoor grills or cooking outdoors of any kind is prohibited unless Tenant has received Landlord's written permission." Which I have, and does not specify what I use.

Regardless, I'm going to give the Bradley and TBE to my gf's father with rights for me to use at my convenience. They only live 45 min. away.

I don't know if this can be disputed:
"Landlord can change or add any rule as needed in Landlord's judgement for the safety, care, maintenance, operation and cleanliness of Tenant's apartment. Tenant agrees that any changes to the rules or additional rules are part of this lease agreement."

The blanket. Now looking for houses.

Two things, I don't want to interfere with other resident's comfort or happiness in this complex. It's beautiful here. I also don't want them to see me defeated and come after my cigars.

The complaining party lives one floor above and always has their screen door open and usually have clothes drying on their balcony. I would have much rather them come to me and work out a schedule, i.e., I smoke in the morning hours when their windows and screen is shut...but oh well.

Like you said.......buy a house. Get the housing market going again. It's good for every one. Be the KING of your domain. Build build build you American friends. Buy Canadian lumber ....build build build.......every body will be happy. Even the person living above you.  ;)

It's always that 1 % of the people that get to tell the other 99 % what the hell to do, one of the best smells there is, Is something smoking and cooking bbqing...

We own a condo and our strata says no gas or briquette grills only electric, so I went and bought and electric and made sure my Bradley was allowed before buying the place. I also make sure that the Strata Council gets some smoked salmon a few times a year along with the owner above us. Now I am thinking of getting a pellet pooper because they are electric. Now just to get it by SWMBO. ;)

Well so you can no longer use an electric cooking unit outside. Can you still use your electric stove (assuming it is electric) and the microwave in the kitchen? If so, don't bake or cook anything that might have an odor or you may have to always go out to eat. I would be tempted to burn something everyday on the gasser.

You can still generate plenty of smoke with a gas grill.  Just make up a few aluminum foil packets with wood chips and some holes in the top.  Set them on your grill, next to the meat you want to smoke and go to it.  Wait until the upstairs residents hang their laundry out to dry before starting this.   ;)

please, please, please, please, do what ever you can to generate as much smoke as humanly possible on that gas grill.  burn logs, when you're not cooking, use wood chunks to cook your food, etc, etc, etc....

at all cost, keep that gasser smoking when in use and when not.

I'm liking the idea of an SRG. Go with the tommy ring at the bottom and load it up with some wood or pellets. The side chute for wood doesn't do the job. IMHO.

So I met with the complex management this afternoon, having had a full 24hrs to cool off. Now this may sound a little conceided, but I know how to put my best foot forward and turn on the easy-going charm when needed.
By the end of the meeting, I had been offered a much better, newly remodeled appt on the top floor of another bldg overlooking the lake, and with a fireplace, for the same price as what we're paying now...with a written agreement that I can use my smoker.
Yes, that means I'll have to bubble-wrap all my crap, but I'll be paying someone to lug it up three flights of stairs.

My new approach, kill them with kindness: this new appt won't be ready till mid July. In the meantime I'm going to write a nice letter to the family above, apologize for the nuisance, ask them to be a little more forthrigh. I will include a nice gift card to the best Turkish restaurant in Philly. (they are Turkish)
I now want them to feel like crap for back-channeling me, and open lines of communication for the month and a half before we move. Maybe we can work a compromise in the meantime...

Thoughts?

Killing them with kindness is a good idea.  I was going to suggest that you invite them for dinner and blow their socks off with some good ol' baby back ribs. 0oops are Turks Muslims?  Could be that's the problem.  All that smoking pork.... Anyway, friendliness has ALWAYS worked for me.

I wouldn't buy them anything. They basically went behind your back instead of coming to you first and working it out. I would simply just not smoke (yes I know that is tough) or take the smoker somewhere else that you can use it on a regular basis until you move. They obviously didn't care about you and were more focused on them. Move out, smoke some ribs and have a big fat ol' victory cigar because you won in the end my friend.

BTW they will probably complain about the next person that is under them next as well...

As far your approach to the neighbors I see that taking one of two courses. 1) they feel like total A**holes for stirring up all of this and causing all of this grieve for someone who is obviously a good person - you, and maybe they will apologize or 2) they just learned that complaining is the best solution because they just got the offending party kicked out of his apartment and on top of that were given gifts and they will forever feel that they won big time. Depends on what kind of people they really are. Good luck and lets hope they are good people.

Your response should reflect your character.  Do not worry about how the other folks will interpret it.   

If you doing it to subtlety try to induce some remorse in them then in my opinion it is a false effort and should not even be done.   IF your intent is to truly open lines of communication and/or begin some form of relationship with them then I see that as upright, honest, and admirable and you should do whatever your character demands of you.

Take the high road and move on.   In the end it seems you got a better deal with no restrictions so rejoice in the blessing.

All great recent replies!

To update, I did follow through with the gift card, it did open tons of communication, and things right now are ok. I told them I was not trying to coheres them into me using the smoker before we move and that it is no longer an issue.  They are good people, the mother quickly admitted to me that she was very intimidated by me, just because I am a well spoken, 230 lb, 6 foot gymaholic, and that is why I was routed.

They keep all their windows open because she openly stated that they can't afford the bill for a/c. She only moved her and her kids to this (nice) complex so they would be in this particular school district.

Anyway, as far as my response reflecting my character, the more I sat on the issue, calmed down and tried to put myself in their shoes, the better my intentions were...for what it's worth. Not perfect, but I am who I am.

In the end, I'll still have a lot of summer to smoke, I'll get a bigger &  better appt, and was able to meet and befriend the neighbors above in the meantime.

Yes, I won.
